Terms of Sale
These Terms of Sale apply to every order placed on us.elettia.com. The version in force on the day of your order applies; the version dated above is the current one.
1. Scope
These Terms govern the sale of new or refurbished consumer electronics and home appliances by to consumers, shipped within the 48 contiguous United States. Placing an order means you accept these Terms in full, through a separate checkbox before payment.

3. Products and availability
Products are described as accurately as possible. The technical specifications shown come from the sources indicated on each product page; photographs and marketing text are not binding and do not commit the seller beyond the technical specifications and required disclosures.
Offers are valid while displayed on the site and while supplies last. The availability shown on each product page is refreshed regularly; if an item turns out to be unavailable after your order, you are informed without delay and refunded in full within fourteen days of payment.
4. Prices
Prices are shown in US dollars. The total shown before you confirm payment — products and shipping — is the amount charged. Where a state or local electronic waste recycling fee applies to a product, it is included in the displayed price and recorded line by line on your order (see environmental fees). Shipping charges are shown before the order is confirmed and detailed on the shipping page.
When a crossed-out price is displayed, it is the lowest price actually charged during the thirty days before the reduction was applied, and the date of that reading is shown next to it. No markdown is displayed without that dated reading.

5. Ordering
Ordering takes four steps: building the cart, entering the shipping address and shipping method, reviewing the detailed summary, then confirming by payment. The summary lets you correct any error before confirmation: the order is only final after that second confirmation.
The sale is concluded when payment is received. A confirmation email is sent to you without delay, listing the order, the shipping address and a reminder of these Terms. The contract is kept on file by and you can obtain a copy on request at [email protected].
reserves the right to cancel any order that appears abnormal, in particular after a previous payment dispute or on suspicion of fraud. The customer is informed and refunded in full.
6. Payment
Payment is made online by credit or debit card, at the time of the order, on our payment provider's secure page. Card details never pass through our servers and are never stored by . Transactions may be subject to cardholder authentication.
Installment payment, when offered, is provided by our payment provider under its own terms, disclosed before you accept it.
Title to the products passes to you upon full payment. Risk of loss passes to you when the products are delivered to you (section 7).
7. Shipping
Products are shipped to the address given at checkout, within the 48 contiguous United States. Delivery times, shipping methods and charges are detailed on the shipping page and repeated before payment. Unless otherwise stated, orders ship within thirty days of the order, as required by the FTC Mail, Internet, or Telephone Order Merchandise Rule.
If we cannot ship within the stated time, we notify you, offer a revised date and let you cancel for a full refund; if you do not agree to the delay, your order is cancelled and refunded in full within seven business days.
Risk of loss or damage passes to you when you take physical possession of the products. Please check the condition of the package on delivery and note any damage with the carrier, then let us know within three business days: this makes handling easier and does not limit your rights.
8. Cancellation and 14-day return policy
You may cancel an order free of charge at any time before it ships. Once delivered, you have fourteen days from receipt of the last item of your order to return it for a refund, with no reason required. This is our return policy; it is offered in addition to any rights you have under the law of your state.

Return shipping is at your expense unless the return results from an error on our part or from a defect. The refund is issued within fourteen days after we receive the item or proof that it was shipped, to the same payment method used for the order.
A deduction may be made for the diminished value of an item handled beyond what is needed to establish its nature, features and operation.
9. Warranties
Warranty information
Products sold on us.elettia.com may be covered by a written warranty from the manufacturer. Under the Magnuson-Moss Warranty Act, the terms of any written warranty are available for you to read before you buy: ask us for them at any time, and keep the documentation delivered with the product.
Independently of any written warranty, most states provide an implied warranty of merchantability: the product must be fit for the ordinary purposes for which such products are used. Where you told us a specific purpose and relied on our advice, an implied warranty of fitness for that purpose may also apply. The duration of implied warranties and the remedies available vary from state to state.
A product that is defective, does not match its description or arrives damaged can be returned to us at our expense for repair, replacement or refund, as described on the warranties page. Your order number is the only proof of purchase we need.
Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so limitations stated in a manufacturer's warranty may not apply to you. This warranty information gives you specific legal rights, and you may also have other rights which vary from state to state.
Implied warranties
Implied warranties under state law apply even when the manufacturer gives no written warranty, and cannot be disclaimed for consumer products sold with a written warranty or a service contract. A defect that existed at delivery but only became apparent later is covered for as long as your state provides; contact us as soon as you notice it.

The period during which spare parts essential to the use of the product are available, as communicated by the manufacturer, is shown on each product page. When the manufacturer does not provide it, the product page says so explicitly.
10. Take-back of old devices
takes back your old device free of charge, limited to one device of a type equivalent to the one purchased, through a free return process. Details are on the recycling program page.
11. Liability
is responsible for the proper performance of the contract, except where non-performance is attributable to you, to the unforeseeable and unavoidable act of a third party, or to an event beyond our reasonable control.
To the extent permitted by applicable law, our liability for any claim arising from an order is limited to the amount paid for that order; nothing in these Terms limits liability that cannot be limited under the law of your state.
The site may be temporarily unavailable for maintenance; such interruptions do not give rise to compensation and do not affect orders already concluded.
12. Personal information
The information collected at checkout is needed to process the order and is handled as described in the privacy policy. You have rights to know, access, correct and delete your information and to opt out of its sale or sharing, exercisable at [email protected].
13. Customer service and complaints
Customer service answers at [email protected] and at . Any complaint must be sent in writing; a reply is given within a reasonable time, and at the latest within one month.
14. Dispute resolution
If a complaint sent to customer service is not resolved to your satisfaction within two months, you may use the dispute resolution service participates in, . Contact details and conditions: dispute resolution. Nothing in these Terms prevents you from bringing a claim in small claims court or with your state's consumer protection agency.
15. Governing law
These Terms are governed by the laws of the State of and applicable federal law of the United States, without regard to conflict-of-law rules. Where the consumer protection law of the state in which you reside gives you rights that cannot be waived, those rights apply.
Nothing in these Terms deprives you of rights granted by mandatory provisions of applicable law. If any provision is held unenforceable, the remaining provisions stay in force.
